Communicating Justice Providing Legitimacy.

På en övergripande nivå handlar avhandlingen om det juridiska systemets funktion i styrningen och reformeringen av moderna välfärdsstater. I fokus finns en analys av domstolarnas roll som konfliktlösare i situationer där det uppstått en konflikt mellan den enskildes behov och kollektiva intressen i mål som rör rätten till sjukpenning.

Arbetet bidrar med en analys som är relevant för tre olika intresseområden:

1. Det juridiska systemets roll som förmedlare av legitimitet i styrningen och reformeringen av den moderna välfärdsstaten.
2. Krisen på 1990-talet och dess effekter i form av t. ex. renodlingen av socialförsäkringarna och åtstramningen av kriterierna ”sjukdom” och ”arbetsförmåga”.
3. Juridikens betydelse i debatten om social och ekonomisk politik och dess realiserande.

En slutsats som dras i studien är att de svenska förvaltningsdomstolarna utgör ett effektivt fungerande system för implementering av socialpolitiska strategier, men det konstateras också att förvaltningsdomstolarna har en potentiell kapacitet att utöva lagen på ett sätt som skulle kunna öka hållbarheten i välfärdsstatens program och att denna potential för närvarande är långt ifrån fullt utnyttjad

The book is on an overarching level confronting the function of the legal system in the governance of modern welfare states. The point of departure is an analysis in which the conflict between individual needs and collective social risks is highlighted, and the role of the courts in resolving this conflict, is in focus.
The work contributes to an analysis relevant to three different areas of interest: 1) Law and governance in modern welfare states and the role played by the legal system as a provider of legitimacy. 2) The Swedish response to the crisis of the 1990s, the introduction of the ‘concentration policy’, the tightening of the criteria of ‘sickness’ and ‘capacity for work’ and the reflection of these policy changes in legal practices. 3) The role of legal science in the debate on social and economic policies and their implementation. Overall, the study concludes that the Swedish administrative court system could be described as an efficient implementation machinery in which social policies are effectuated promptly, but it is also concluded that the administrative courts have a potential capacity to practice law in a way that could increase the sustainability of the welfare state project and that this potential is far from being fully exploited at present
